摘要
刚刚生效的《物权法》在《民法通则》及《合同法》的基础上,又进一步吸纳了观念交付理论,并明确规定了观念交付制度,学术争鸣性质的观念交付由此转变为有立法支持的现实法律制度。观念交付是我国物权变动公示体系的重要组成部分,观念交付与现实交付、拟制交付之间存在诸多区别,它经历了相对独立的生成路径,拥有不同的表现形式和明确的法律构成。物权形式主义理论是观念交付制度的法理基础,观念交付制度秉持效率优先兼顾安全的法价值理念。
The Real Law ,just taking effect, on the base of The General Rule of Civil Law and The Law of Contract , further absorbed the theories of idea consigned, and established definitely its position in our legal system. The consign have changed from academic forum to realistic law system. The idea consignation is the importance part of our legal system, there are many differentiations between the idea consigns and others. It has its own born path and different law composing. The formalism theories on real right is the legal theory foundation of idea consign. The idea consign adhere the legal value principle that the efficiency has priority and give consideration to the safety.
