摘要
福利权作为我国宪法中确认并加以保障的重要权利之一,在转型期的中国如何获得更好的保障,不仅仅是应对制度困境的需要,同样也应成为公法学者的关注课题。从目前我国的宪法规范来看,相关内容已较为全面。但是,其实现仍面临着诸多难题。理想的路径是建立违宪审查制度以确保福利权的实现,而在该制度尚未建立之前,行政诉讼及福利行政过程中的相关保障也可以作为选择路径之一。
As an important type of right, welfare rights have been affirmed and protected in our constitution. In the transition of China, that how to protect them isn＇ t only need for the questions in system, but also is the concerning topic for specialist in public law. The context on welfare rights in our constitution has been compressive and influence. To enforce these rights still face several problem. So, ideal enforcing path is constitional review. Of course, the practical path is along with some protected measures in the process of administrative procedure and welfare administration.
