摘要
以专业化、高效率为特征的行政调解在医疗纠纷处理中未能达到制度设计者预期的目的。通过实证调研的方法,检讨当前医疗纠纷行政调解制度所存在的问题及其症结,并提出重构医疗纠纷行政调解制度的初步构想。
The administrative mediation system characterized by its specialization and efficiency has failed to realize the expectation of system designers in the medical disputes. The essay analyzes the problems and underlying causes in the administrative mediation of medical disputes by empirical investigation. Then, preliminary suggestions are put forward, concerning the reconstruction of an administrative mediation system of medical disputes.
