摘要
县公安局诉失实报案人案虽取得了一定的良好社会效果,但却与国家赔偿责任的基本理论相冲突,故其缺乏充足的法理依据。并且,它展示了公安机关通过"官告民"的诉讼形式,规避国家赔偿责任的实质。
The case in which the public security bureau prosecutes the wrongful informant has achieved certain good social effects. However, this case is contradictory to the fundamental theory of state compensation obligation; so the author thinks that this case lacks support of the legal principle. The article reveals the substance of the case in which the public security organ avoided state compensation obligation by prosecuting the person who wrongfully reports the case.
