摘要
检察权的产生、性质、特征、运行及发展与司法规律密切相关,只有掌握和正确认识司法规律才能完善检察机关的法律监督工作机制,加强对检察权行使的保障,维护检察工作的整体性、统一性,从而明确检察人员客观义务,加强对检察机关自身执法活动的监督制约,逐步实现检察机关事权、人权、财权的统一,建立相对独立的检察官管理体系,保障检察官承办案件的独立性和主动性。
The origin, characteristics, operation and development of procuratorial power are closely related to justice law. Only when justice law is truly understood, can we perfect the supervisory mechanism of law, strengthen the protection of procuratorial power, ensure the integrity and unity of the procuratorial work. Moreover, we can clarify the objective obligations of procurators, strengthen the supervision of law-enforcement authorities in performing their responsibilities, gradually achieve the unity of responsibilities, human power and financial powers, and finally establish relatively independent system of procurators management to ensure their independence and initiative in cases.
