摘要
英国最低工资制度的内容主要体现在《1998年全国最低工资法案》及《1999年全国最低工资条例》中。最低工资制度的内容包括最低工资的标准、适用对象、工资的定义和范围、最低工资的计算方法、最低工资的执行和法律救济等等。我国规定了最低工资制度,但该制度还存在许多不足,应当借鉴英国的做法加以完善。
In the UK, the National Minimum Wage Act 1998 and the National Minimum Wage Regulations 1999 are the main sources of national minimum wage law. The Act 1998 and the Regulation 1999 deal with the issues as to how national minimum wage rate is set, the coverage of minimum wage, the definition of wage and its scope, how to calculate working hours and the enforcement of the national minimum wage law, etc. China has adopted minimum wage regime, but considerable room for improvement still exists. In light of the experiences in UK, China should improve the regime of minimum wage in many aspects.
