摘要
医疗事故鉴定是我国医疗纠纷中的重要证据之一。然而,在司法实践中其合法性、公正性受到质疑。从证据学角度分析,医疗事故鉴定符合我国证据的合法性、关联性和客观性,具备证据能力。问题的关键在于如何准确把握医疗事故鉴定的证据效力。
Medical malpractice evaluation is one of the most important evidences in suits caused by malpractiees. However, its characteristics are theoretically disputable. Its legitimacy and fairness are queried in practice too. From the angle of evidence theory, medical malpractice evaluation has the credibility of evidence because of its legitimacy, relevance and objectivity. The key problem is how to grasp its effect of evidence exactly.
