摘要
几起商品有效期、生产日期标识案件,提出了消费者知情权保护中的法律问题。在民法的调整中,交易一方的知情利益是通过交易对方承担告知义务的模式加以确认与保护的。但在现代社会中,消费者的知情利益在这种保护模式下难以得到有效的保护。因此,消费者知情权有必要予以确立。由此可见,作为经济法主体的消费者所享有的知情权,是克服民法的局限而确立的。同样,有关经营者、政府等经济法主体的权利,也可依此思路加以发现与总结。
Several cases regarding to expire and production date of commodities raised legal issues on the protection of consumers' right to information. In civil law, the benefit of information of one party in a transaction is recognized and protected by the other party' s duty to inform. In modern society, however, such right of a consumer is hardly protected under this mode. Therefore, there is a need to establish consumers' right to information. From the above logic, the right to information of consumers as subject of economic law is shaped to overcome the deficiency of civil law. In the same way, the rights of other subjects of economic law, such as business operators and the government, can be discovered.
