摘要
准确界定卡普的经营性质,有利于加强道路运输管理,有利于汽车工业的可持续发展。从道路运输法的基本理论入手,运用定量分析和逻辑分析方法,对卡普的经营性质进行全面、深入分析。分析结果认为:绝大多数卡普为非经营性运输行为,不是非法经营行为;对卡普的划一化管理不符合现行法律规范;道路运输管理机构应加强对卡普的分类管理。
Accurate definition of carpool service helps to strengthen road transportation management and the sustainable development of automobile industry. In light of the basic theory of road transportation law and through quantitative analysis and logic analysis, an overall and thorough analysis on carpool profitability is made. The result shows that carpoot service is mostly non-profitable, instead of illegal. Accordingly, the uniform administration for the carpool service does not conform to the current laws, the highway transport administrations should strengthen their classified administration for the carpool service.
