摘要
随着人权保护进程的推进,家庭暴力已成为国际社会普遍关注的问题。作为一种社会现象,它普遍存在于古今中外不同的社会形态中,在中国传统法律中被称为"亲属相犯"。尽管从表面上看,它与当今国内外及联合国法律文件对"家庭暴力"所作的规定有不少相似,但在概念和理念上却有着极大的差异。
With the improving of human rights＇ protection, domestic violence has become the general concern among intemational community. As a kind of social phenomenon, generally existing in various social stages all over the world, it was called ＂Infringement among Kinship＂ in Chinese traditional law. Although it is apparently much similar to the ＂Domestic Violence＂ stipulated in documents of UN and other nations, it is significantly different from domestic violence in content, objectives and ideas. The paper makes comparison between the two systems under completely different culture backgrounds and then provides useful historical reference for the constructing of China＇ s harmonious society under rule of law with status, gender and human equality.
