摘要
"榜例"作为法律用语和法律形式始于明初,曾在明代立法和司法活动中广泛使用。我国学界尚未对这一法律形式进行过研究。文章利用大量文献资料,对明代榜例的制定、功能、演变、实施状况做了系统考析,揭示了明代榜例的概貌及其在法律体系中的地位。
Bangli （榜例） as a legal term and a legal form originated in early Ming Dynasty. It was widely employed in the legislation and judieial activities during Ming Dynasty. So far, in China＇ s legal circle, no research has yet been conducted on this legal form. By referring to a large number of relevant references, this paper makes a systematic investigation of the formulation, function, evolutionn, and enforcement of Bangli in the process of Ming Dynasty, drawing a general picture of Bangli and revealing its status in the system of law.
