摘要
随着近几年劳资纠纷层出不穷,劳动者权益屡受损害,国家相继颁布了《劳动合同法》、《就业促进法》、《劳动争议调解仲裁法》等一系列劳动法律法规。但是新法的颁布并没有如期所愿,使原来的不法现象得以缓解,使劳动者权益的维护得以改善,相反,出现了大批裁员、批量劳务派遣等规避法律的现象。为此,针对法的实施问题,追溯到山西票号中"活法"的有效实施,其没有国家强制力的保障,却得到很好的遵从。这都得益于其诚信、利益等理念的巧妙运用。
With the fact that labour disputes are continuing without end over the past few years. Labourer rights and interests has repeatedly suffered, a series of labor laws and regulations have promulgated such as " Contract Law of Labour Employment Promotion Act ", " Labour Disputes Mediates Arbitration Law " etc.. However these new laws have not brought about the expected effect, Incrder to solve the problem, the author makes analysis of the effective ifnplentation of " living law" in Shanxi Bank and concludes that it was depended on the skillful applicution of some ideas, such as honesty , justice and benefit.
