摘要
在公平正义的价值观下,基于农民发展权和环境权角度对农业生态补偿权进行分析。通过分析农业生态效益补偿由正当利益逐渐升华到现实权利的过程,指出建立农业生态补偿机制的现实意义和实现农业生态补偿权利的法制化路径,并从宏观、中观和微观层面上阐述了如何实现农业生态补偿。为实现促进农业发展、保护农民利益和实现生态文明提出建议。
In the values of fairness and justice, the article analyzes the right to compensation for ecological agriculture based on perspective of peasants＇ right to development and environment. By analyzing the course that agricultural eco-efficiency compensation is gradually sublimated from legitimate interest to actual right,this article points out practical significance of establishing agro-ecological compensation mechanism and legalized path of realizing the right to the agro-ecological compensation. Then, it describes how to realize agro-ecological compensation from macro-view, medium-view and micro-view and puts forward some suggestions for promoting agricultural development, protecting interests of farmers and realizing ecological civilization.
