摘要
体育运动技术动作创新是体育运动的生命。体育运动技术动作不应受专利法的保护,因为其难以满足授予专利权所必需的新颖性、创造性和实用性等实质性条件;体育运动技术动作的创新动力源于在体育竞赛中获胜给运动员带来的经济、精神上的愉悦和满足,并不源于专利法的保护;赋予体育运动技术动作专利权会不正当地限制体育赛场上的竞争,使体育比赛的观赏性大为降低,不利于体育事业的健康发展。
Innovation of sports technical moves is the life of sports. Sports technical moves should not be protected by Patent Law, because it＇s very difficult to meet the substantive requirements needed to granting a patent. The incentive of innovation of sports technical moves derives from the economic and spiritual happiness and the contentment brought to the sportsman from winning the sports games, not from the protection provided by Patent Law. Granting patent to sports technical moves would be improper and limit sports competition, and would hinder the development of sports.
