摘要
企业基于其"理性经济人"的本性,会给其利益相关者带来负的外部性。经济法对此外部性的克服主要是通过倾斜性配置外部性供体即企业与受体及其外部性承受对象之间的权利与义务,以实现实质上的公平。具体途径是赋予外部性受体倾斜性的权利并保证其实现,具体表现为企业对自然人、自然界、所在社区和社会公益承担社会责任。
The enterprise will bring exterior nature based on their ＂rational economic man＂ natural disposition,The economic law will regulation the disposition of right and duty, realize the balance substantially. Exterior the concrete way is entrusts with the acceptor incline right and guarantees its realization.
