摘要
国内外刑法学者对教唆犯理论的研究已经非常深入,但在教唆犯的性质、概念和处罚原则上仍存在诸多观点。本文在对教唆犯性质的几种观点进行归纳的基础上,分别对教唆犯的预备、未遂和中止形态进行了分析。
The domestic study on abettor theory is quite deep. But there are many kinds of ideas on the nature, the concept and the punishment principles of abettor. The paper induced several ideas on the nature of abettor and analyzed the forms of preparatory, unfulfillment and suspension.
