摘要
经济法的基本属性是什么,一直是经济法学研究中的一个争论焦点。文章通过对国家干预一词的语义解释,论证了国家干预是一个连续的历史过程,在此基础上,通过对国家干预经济的法律文本解读,阐明了经济法的基本属性是国家对社会经济生活的干预,接着从实证的角度考察了国人受益于国家干预的情形,同时引述了外国学者对中国国家干预绩效的评价,最后提出了完善中国国家干预运行机制的若干构想。
The question of what the basic attribute of economic law is has always been one of the bones of contention in economic law research. This paper, through the semantic interpretation of state intervention, proves that state intervention is a continuous historical process, and on the basis of analysis of legal texts of the sate intervention clarifies that the basic attribute of economic law is state intervention on social and economic life. Then, from the positive angle, this paper explores situations in which the Chinese people benefited from state intervention and quoted the evaluations of foreign scholars about the performance of state intervention in China. Finally, this paper proposes some notions of improving the operational mechanism of the state intervention in China.
