摘要
本文通过对森林资源物权属性的分析,认为森林资源具有特定性、可支配性和稀缺性,符合物的基本属性,可以作为林权的客体。同时,将森林资源作为林权的客体,突出体现了森林的生态效益、经济效益和社会效益,有利于林权人收益权的充分实现和森林生态的可持续发展。
This paper makes an analysis of forest rights from the perspective of property rights law. It concludes that the basic attribute of certainty,controllability and scarcity makes forest resources the object of forest rights,which reflects the ecological benefit, economic benefit and social benefit of forests and helps to realize fully the rights of usufructuary and the sustainable development of forest ecosystem.
