摘要
直接故意的程度差别应当在刑事司法中有所考虑,这是实现量刑精确的要求。行为人的事实年龄、被害人的同意、由于被害人过错而引起的行为人的情绪状况、预谋时间的长短和行为人对因果关系认识的确定性程度,是决定直接故意程度的因素。
The difference of actual intent degree in criminal justice should be considered, for it is necessary to achieve justice precise. The factual age of the actor, effective homicide victim consented, the emotional condition arising from the homicide victim＇ s mistake, the length of premeditation time and the degree of the actor understanding the causal relation, are factors on judging the degree of the actual intent.
