摘要
林权交易中心将成为中国市场交易活动的重要场所。林权制度是林权交易市场的制度安排的基础。但是,《物权法》实施以后林业法律面临配套修改问题,林业政策和法律法规的滞后使林权交易面临各种法律风险。林权本身存在特殊性,不同的林权主体所享有的权利内涵与范围不同,林权的行使方式与一般的物权行使方式不同,林权受到生态公益的限制,以及林权交易方式的多样化,均可能导致林权交易风险。
Centre for forest right exchange will become an important site of market exchange. The legal system of forest right is the foundation of system arrangement on forest right exchange market. But there will be various legal risks because of forest laws in face of revision after implementation of the Real Law. The reasons of legal risks in forest right exchange may include： the particularity of forest right, the difference of right＇s content and boundary among forest right holders, the difference ways of right exertion between forest right and general real right, the ecological limitation to forest right, and diversification of forest right dealing ways.
