摘要
人民陪审员制度是人民法院吸收普通公民与职业法官共同参与案件审判活动的一项司法制度,但因立法的不足和制度的缺陷,该制度在我国司法实践中还存在些问题。时值国家修订诉讼法之机,研究和探讨人民陪审员制度非常重要和必要。本文对我国人民陪审员制度的立法和价值进行论述,对其存在的问题进行详细分析,主张在改革和完善的基础上坚持和发展人民陪审员制度,提出完善与改革的构想和建议。
The people's juror system is a legal system for people's court to obsorb ordinary citizens and professional judges to participate case trials, but still some problems remains in this system during judicial practices out of legislative and system flaws. In this time when the procedural law is revised by our country, it becomes rather important and necessary to research and discusse the people's juror system. This paper elaborated the legislation and value of the system, analyzed in detail the problems in it, advocated to persist and develop this system based on reform and consummation. Meanwhile, this paper advanced the conception and suggestion of the reform and consummation.
