摘要
民办学校财产权是指民办学校对其财产享有的占有、使用、收益和处分的权利。然而,我国现行法律法规对民办学校财产权关系的界定并不清晰,影响了投资办学的积极性、学校财产管理的积极性及学校资源的合理配置。因此,应对现行民办学校财产权制度进行重构,明确民办学校存续期间财产权的归属及其终止后剩余财产的最终归属,重新界定合理回报的性质,明确出资者的出资额不随校产增值而扩张,从而促进民办学校实现可持续发展。
The property right of non-governmental school indicate the non-governmental schools' right of possessing, utilizing, benefiting and disposing of their property. However, the present law and regulations don't define clearly to the relationship of property right of non-governmental schools, which has negative impact on the positivity of investing in schooling and property management of schools and reasonable collocation of school resources. Therefore, the present system of non-governmental school property right should be re-constructed, and the contents are: clarifying the ascription of its property right during the running of school and the ascription of its surplus property right after its ending, re-defining the nature of reasonable return, clarifying that the quantity of contribution of investors can't enlarge with the increment of whole school property to promote the sustainable development of non-governmental schools.
