摘要
房地产违法交易行为是指不符合条件擅自预售商品房、捂盘惜售、囤积房源、制造虚假信息恶意炒作、哄抬房价等影响房价的行为,其造成了房地产市场秩序混乱的局面。这不仅使得许多民众居住条件不能改善,而且带来了许多严重的社会问题。在指明其危害性和剖析其可罚性的基础上,建议将房地产违法交易行为犯罪化,以威慑和遏制不良开发商的违法行为,保障民众的居住权,建立安定团结的和谐社会。
The illegal transaction behaviors of the real estate refer to selling the commodity apartment arbitrarily in advance, storing the aparments not to sell, making fault information and driving up the price, which has made the real estate market in disorder. This could not improve peoples＇ living conditions, but bring a lot of serious social problems. In such circumstances, social harmony will not be reached. This paper here suggests that the perpetrators of real estate transactions of the law deter and contain the unscrupulous developing offences, protect the people＇s right, and establish a stable and harmonious society.
