摘要
社区矫正作为一项新生事物虽然在很多地区开始了试点工作,但由于主客观因素的制约,目前实行社区矫正的社区主要还是指城市社区,农村社区在社区矫正试点工作中还是"盲区"。如果以三个理念源——利益协调、和谐理念和生存发展权为基点,并对观念、立法、管辖、形式、机构、队伍建设六个方面问题进行考量,就能探寻出完善农村流动人口罪犯社区矫正的路径。
Community reform program, as an urban-centered new way of penalty outside prison, has been experimented accordingly in China in recent years. However, it is a ＂blind spot＂ in rural communities till now. Whether there are coordinated benefits, harmonious viewpoints, and survival rights or not determine a successful implementation of the program. Floating criminals from rural areas would be reformed in communities only by ways of eliminating the stereotypes, perfecting relative laws, and reinforcing the governing and the judicial institutions.
