摘要
夫妻离婚,法律赋予了无过错方损害赔偿请求权,而子女的利益同样受到了损害,法律却视而不见。有损害就应该有救济,子女的损害能够通过怎样的方式予以填补?本文就是在这样一种考虑下构想关于子女享受家庭生活权的建立以及基于此权利向离异父母的损害赔偿请求权。
The broken family caused by divorce not only affects the couples but also affacts the interests of children. The innocent party of the couples is entitled the claim right for compensation while the law ignores the damage to the children＇s interests at the same time. Where there is a damage, there should be a compensation. How could children＇ s damage be compensated？ Under this circumstances, this essay considers the establishment of children＇ s right of enjoying family life and the right of claim for the damage to the divorced parents based on the claim right.
