知识转型背景下的中国法律史——从中国法学院的立场出发 被引量:13

摘要 就其学术范式而言,当今中国法学院中的中国法律史研究/教学,仍然是传统的史学风格占据着主流地位,而未能在知识体系中真正融入法学的主流传统。这种状况,致使中国法律史往往被视为是"虚学",在注重实务取向的法学院中日趋边缘化。造成这种窘境的深层原因在于,中国近代以来频繁的法律断裂性变革及其带来的"知识断裂",使得中国法律史研究丧失现实运用的可能性;而在普通法传统中,却存在着弥合"时空距离感"并因而赋予本国法律史以现实意义的机制。欲求超越目前的困境,传统的说教并无太多助益。可能因应之道在于,在注重法律人思维方式培养这一方向下,加强三个具体实域的探索与开拓,最终促成中国法律史在法学院中的知识转型。 As far as the academic paradigm is concerned, it is the style of traditional history, not of law science, legal history in which is still Chinese law occup school ying the main position in both the research and teaching of Chinese s nowadays. Unfortunately, under such circumstances, more and more people tend to consider the Chinese legal history as a subject of little importance, at least, of no direct help, to legal profession. The root brought about such awkward situation lies in the fact that China has experienced so many transformations of legal system since last century that the knowledge of Chinese legal history has lost the possibility of being used in practice directly as a result. While in the tradition of common law, there exists a special mechanism which gives significance to the study of legal history even nowadays. To overcome the current awkward problem, there will be no aids if we only depend on the traditional sermon as before. The solution to it, in my eyes, perhaps is attaching more importance to the training of legal thinking by the exploration in three fields, which may help bring about the knowledge transformation of Chinese legal history in Chinese law schools finally.
