摘要
农民平等权是"二等公民"、"受损者"的平等主张,即作为中国社会大家庭中平等的一员,农民享有或应当享有与其他成员同等的权利、公平的利益以及受到平等对待。就其性质而言,农民平等权是一种基本人权,同时具有三代人权的属性,既是一项消极权利也是一项积极权利,并且是建立在形式平等之上的实质平等要求。因此,保障和实现农民平等权对农民问题的解决具有终极意义。
Farmers' equal right means that,as the equal member of Chinese society,the farmer should enjoy the same rights,the fair benefits and receive the equal treatment as other social members.As for the essence,farmers' equal right is a fundamental human right and has simultaneously three generations of human rights' character;it is not only a negative right but also a positive right.And farmers' equal right will play an important role in solving farmers' problems.
