摘要
刑法的社会属性与法律特性决定其具有独特的社会和谐功能。刑法的广域公正性使得刑法成为促进整个社会公正的必要手段;刑法的固有斗争性使得刑法表现为一种保护最广大合法权益的终极性特殊强制方式;刑法的独有谦抑性使得刑法具备防止滥刑以最大限度保障人权的基本条件;刑法的显著人道性则对和谐社会人本核心价值观的形成与践行具有直接推动作用。
The social and legal character of criminal law determines its special function of social harmony. The fairness of criminal law makes it become the necessary means to accelerate the process of social justice. The inherent belligerence of criminal law makes it become a special forceful means to protect the legal interests of the public. The tolerance character of criminal law makes it become the basic condition to fully guarantee human rights.
