摘要
知情权是当代法治社会中的一项基础性人权,它在行政法律关系中具体体现为行政知情权。行政知情权是世界各国宪法和法律乃至国际公约普遍确认和规制的重点,它主要通过政府信息公开制度予以实现。然而,就我国现状而言,无论是在公民行政知情权理论研究方面还是实现公民行政知情权方面都相对滞后。本文针对我国行政知情权在落实过程中存在的问题进行了分析,并在此基础上提出了自己的一些见解。
The fight of know, one of the basic human fights stipulated by law in modem society, embodies the administrative fight to know in administrative legal nexus. And the administrative fight to know, focus of the Constitution and the related laws in every nation, is confirmed and regulated by international conventions and implemented through the publicity system of government information. However, at present there is a legal lag in the theoretical study and the implementation of citizens＇ administrative fight of know and in the assurance of government information publicity. The thesis provides some solutions to the problems in the theory and application of administrative fights to know.
