摘要
我国环境行政过程中面临种种利益冲突和裁量失衡,如何实现环境行政裁量的合理性这一问题因而倍受关注。由于环境行政裁量过程中将面对主体层次种类各异的利益冲突,环境行政裁量中的利益衡量在所难免。面对利益衡量过程中固有的理性阻碍和信息阻碍,以及来自对利益评价标准的质疑,裁量者需扩大信息基础,促进公众参与,建立开放性的利益评价体系。
The process of administrating environmental issues in China is faced with all types of interest conflicts and judgment imbalance. How to achieve reasonableness in the administrative judgment causes great attention. The interest conflicts of various types on the part of the subjects in the course of administrative judgment of environmental issues will inevitably lead to measurement of interests. In front of the blockage of rationality and information and the questioning about the judgment yardstick, the related judges are to broaden the basis of information, promote public engagement and set up an open system of interest evaluation.
