摘要
随着高等教育日益国际化,作为其重要方面的跨境高等教育得到了重大发展,同时也提出了对其进行国际法律规制的需求。这一任务主要在三个平台上以两种不同的方式展开:一个是在WTO和双边及区域性服务贸易协定平台上以成员国承诺的方式展开,进行硬性规制;另一个则是在联合国教科文组织的平台上以指南建议的方式展开,表现为软法劝导。但两者都为成员国创设了义务,应该得到成员国善意遵守。
With the internationalization of higher education, cross-border higher education as an important part of it has developed significantly. At the same time, cross-border higher education also demands regulation of international law. This task is mainly carried out on three forums and in two different manners：One is hard law regulation on WTO and bilateral and regional trade agreements forum and in commitment manner, and the other is soft law advice on UNESCO forum and in guidelines and recommendations manner. Both create obligations for their members and they should be obeyed by their members in good faith.
