摘要
随着网络科技的发展,其所带来的法律问题也日渐显现,博客是否具有著作权及对其如何进行有效保护便是其中之一。国务院颁布的《信息网络传播权保护条例》虽对此前有争议的一些问题进行了回应并作出了相应规定,但仍有不足之处。博客们的活动是借助互联网这样的载体来表达其思想与情感,与那些利用纸质载体、胶片载体等进行的创作活动,在作者行为性质上并无任何差别,博客应具有著作权。
Along with the network science and technology development, the legal matter which it brings also day after day appears,whether the Blog does have the copyright and how carries on the effective protection to it then is one of them. Although the State Council promulgated＂ Information Network Transmission Right Protection Rule＂ front to have dispute some questions to carry on regarding this responded and has made the corresponding stipulation, but still had the deficiency. The Blog activity is draws support from the Internet such cartier to express its thought and the emotion, with these using the paper carder, the film carder and so on creation which carries on, and does not have any difference in the author behavior nature, the Blog shouldhave the copyright.
