摘要
宣告失踪与宣告死亡制度最基本的前提条件是被宣告者具有失踪的法律事实,通过对现有失踪概念的质疑及失踪与死亡之间的关系的分析,确定了失踪的概念,以期为进一步完善宣告失踪与宣告死亡制度提供理论上的支持。
It is the legal fact of missing with the person that is the most basic precondition of the death declaration system and the missing declared system.Through the analysis of a query of the present missing concept and relation between the missing and the death,this text has confirmed the missing concept in order to offer the support in theory for perfecting the death declared system and the missing declared system.
