摘要
对1996年～2004年间国内中药复方专利的申请数量和质量变化进行了全面统计,并分析了中药复方专利授权量和失效量的情况,以及中药复方专利的现状及存在问题。统计显示,中药复方专利申请的数量基本处于每年递增的态势,尤其职务申请情况近年明显增加,但中药复方专利的质量不容乐观,专利授权率、失效率均很高。分析其原因,可能与审查标准设置过低,造成申请数量大、技术含量低、转化实施少有关。
This paper describes comprehensive statistical analysis on the changes of quantity and quality of patent applications for Chinese herbal compound from 1996 to 2004, and analyzes the status of granted and invalid patent quantity, as well as the status and problems existed in patent application of Chinese herbal compound. Statistical results show that the quantity of patent applications particularly duty application for Chinese herbal compound has an annual increase, in recent years. But the quality of patents for Chinese herbal compound is not encouraging. The rates of granted and invalid patents are both high, which is probably related to large application quantity, low content of technology, few patent transformation due to low examination standard.
