摘要
随着法治建设的进一步深入,我国现行的法律解释制度面临着诸多困境,这些问题若得不到有效改善,必将影响我国的社会主义法治建设进程。改革的关键在于,明确法律解释主体的解释权限范围,转变立法解释的法律定位,充分发挥司法解释的主导作用,从而促进整个法律解释体系和谐发展。
With the further development of China＇s legal construction, many problems have derived from China＇s Legal Interpretation System, which will prevent the going of China＇s legal construction. Therefore, it is essential for the law - making institutions to make some innovation of our country＇s Legal Interpretation System. The key points of the innovation is to define he authoritative sphere of the law - making institutions, relocate the legislation interpretation system and develop leading function of juries interpretation system, so as to facilitate the harmonious development of the whole legal interpretation system of China.
