摘要
公平原则、诚实信用原则和信息公开原则是证券市场的三大基本原则,在证券法中具有举足轻重的地位。尤其在当前证券市场空前高涨的形式下,公平问题已成为亟待解决的问题。仅仅从制度及操作层面无法根本解决问题,证券法必须以公平原则为其精神内核,并贯穿于证券法运行的始终。
Three basic principles of justice, honesty and information publication play a very important role to securities market. At present, the issue of justice is waiting for being solved especially as the market is heated. Nevertheless, the justice issue could not be solved ultimately only by systems or operations. This paper researches and gets the right path to the justice of stock market and system mechanism.
