摘要
证据制度是诉讼程序的核心。在实行证据裁判主义的现代诉讼中,诉讼过程就是收集证据、运用证据和审查判断证据的过程。认证是行政诉讼证据制度中的一个极为重要的环节。十几年来的审判实践表明,我国当前行政诉讼中的认证制度尚有许多不完善的地方。文章通过对我国当前行政诉讼认证制度的初步探讨,针对存在的问题,寻求完善我国行政诉讼认证制度的做法。
Evidence system is the key of legal proceedings. Modern lawsuit practise evidence judgementisrn and the course of lawsuit is also the course of lawsuit is also the course of the collecting of evidence, the utilizing of evidence and the judgement of investigation. So, recognition of evidence is a importint course of evidence system of administrative procedure. The trial practice in the passed 10 or more years proved that our country＇ s system of evidence still needs to perfect in many aspects. The essay is divided into there parts. On this essay, the author tries to discuss the current evidential systems of our administrative procedure as recognition of evidence. The essay focuses on the existing problems. And then the author tries to search for the ways to perfecting.
