摘要
“一国两制”使我国成为一个多法域国家,利用各法域之间立法、司法的差异与冲突逃避打击已成为跨境有组织犯罪愈演愈烈的主要原因之一。从粤港澳三地的区域性特点出发,以三地警方多年区际侦查合作的实践探索为基础,创建区域性专项区际侦查合作模式是有可行性的,也是遏制该区域跨境有组织犯罪的有效对策。其基本原则是:坚持“一国两制”原则;平等协商、对等互助原则;尊重对方法律制度原则;公共秩序适当保留原则;以犯罪地为主,以有效惩治犯罪为辅,合理界定侦查管辖权原则;以及简便、及时、效率等原则。
China is a multi -legal system country because of ＂One country and two Systems＂ which is also one of the main reason of organs crimes inter - regions extended across Guangdon, Hong kong and Macao regions . A new pattern of inter - regions investigative cooperation controlling organs crimes should be set up on the principle of ＂One country and two Systems＂ according to inter- regional feature, simple and convenient.
