摘要
德沃金的整个法伦理思想是立基于批判启蒙运动以来所确立的实证主义法学,是试图从当代哲学解释学的立场出发来构建以道德原则为核心的现代法伦理学。实际上,德沃金的法伦理学属新自由主义法伦理学、后现代思潮下的现代主义法伦理学和新自然法伦理学。
The whole Dworkin＇ legal ethic theory, based on the positivistic science of law established after criticizing European Enlightenment Movement, attempted to set up a modern legal ethic theory with the principle of morality as the core and on the basis of the contemporary philosophical hermeneutics. In reality, Dworkin＇ legal ethic theory belongs to that of neo- liberalism, modernism affected by the currents of post-modernistic thought and neo-law of nature.
