摘要
通过对《2006海事劳工公约》主要内容的研读,提出了我国履约的文件体系构想,一是以国家法律的形式,出台国家层面的法律文件,用明确的语言将海事劳工公约中涉及到需成员国承担的法律义务予以明确地规定;二是主管机关(认可的组织)出台一系列的管理条例,作为国家法律文件的补充,对组织的规范经营管理进行规定,对技术层面的问题提出具体要求,对审核、发证以及港口国检查等提出相应的规范;三是行业组织(海员工会)制定相应的管理规定,将国家的具体要求和主管机关的具体要求用规定的形式加以执行。
This article puts forward the conception for our country's implementation on the documentary system based on the study of 〈 Maritime Labor Convention,2006 〉 :firstly, to enact the national law with explicit wording to prescribe definitely the legal obligation undertaken by the member states involved in the maritime labor convention; secondly ,the authorities concerned (recognized organization) legislate a series of byelaws as the supplements to the national law to stipulate the organizational management and administration, to put forward the specific requirements for technical problems, and advance the corresponding criteria for the examination, certification and PSC inspection, etc. Thirdly, the industrial organization (Seafarers" Union) establish corresponding management regulations to implement the two above -mentioned specific requirements.
