摘要
本文按照审理与判决有机统一的要求,分析了现行审判委员会工作机制同现代司法权力运行规律的关系,其特点是影响重于独立、恣意多于自由、领导重于平等,并分析了形成这些问题的原因,提出了建立集体决定,个人负责,意见公开,完善表决程序及固定委员发言顺序等有关工作机制方面的建议。
This essay analyzes the relationship between judicial committee working mechanism and judicial power working rules on the basis that hearing cases and deliving judgments should be consistent. The drawbacks of the mechanism are that there are more influence than independance,more arbitrariness than freedom, more leadership than equity. The reasons for these problems are presented, Accordingly, it is suggested that a judicial committee working mechanism with collective decisionmaking, individual resoponsiblity, openess of opinions,profected voting procedure and fixed order for opinions should be empolyed.
