摘要
法的本质属性决定了法必然在社会中运行,这一运行过程是一个有机联系的整体,因此立法活动本身也要具备社会性,立法充分社会化,法的实效才能深入人心。本文从生育权入手,试探讨我国的立法活动要做到在社会传统文化语境下,充分衡平各方主体利益,切实提高国民对法律的信仰,就一定能为和谐文明的社会秩序的确立和法律的顺畅执行奠定良好的基础。
The essence of the law determines that the law functions in society, which is a connecting process. So legislation must conform to society and then the people admit the law. This paper puts fertility right as an example to analysis the legislation must be adapt to traditional culture in China, balance the interests among the different individuals and improve the law belief. In this way, harmonious social order can be set up and the law can function smoothly.
