摘要
污点证人能作证,是一种特殊证人。污点证人是犯罪活动的参与者,本身有犯罪污点;但可以转而为国家公诉机关担任控方证人,来换取其刑罚的豁免。该制度的确立有利于分化瓦解犯罪人、实现司法资源的有效使用,以适应我国司法现实的需要。从现代刑事诉讼的发展趋势来看,在我国建立污点证人作证豁免制度势在必行。
The stain witness can bear witness, buthe is a special witness. He is a participant of the crime and he has criminal taint. But he can act as the accusing witness for public prosecution to barter for the penalize exemption. The establishment of this system is propitious to divide and demoralize the criminals, make efficient use of the justice resource and suit the need of justice practice. From the developing trend Of modern criminal litigation, it is imperative under the situation to establish the system.
