摘要
在构建社会主义和谐社会的进程中,宽严相济成为中国大陆基本的刑事政策。无独有偶,在海峡彼岸,台湾地区也推出了“宽严并进”的刑事政策,并以此为指导在2005年进行了“刑法修正”。台湾地区刑事政策的调整涉及面广,有其自身的特点,引起学界和刑事司法部门的高度重视,对大陆刑事政策和实践也具借鉴意义。
In the process of constructing the socialist harmonious society, the criminal policy of ＂tempering justice with mercy＂ has become the basic criminal policy in the mainland. Coincidentally, on the other side of the Strait, Taiwan Region also adopts the policy of ＂tempering justice with mercy＂, and takes it as a guide to amend the penal code. The criminal practice of the mainland can learn from the adjustment of Taiwan＇ s criminal policy.
