摘要
法是人基于自我的正义感所做出的反自然的选择,是人类自我保存的必须,尽管它借助了有序冲突的形式,但其意义确在于人类社会的和谐。法为人类社会和谐而生,即法为人而存在,如果背离了这一原初机理,它会异化为人的强大对立面。法与社会之间的和谐问题应属一个重大命题,社会乃法之源,法乃社会之流,人—社会—法,这是一个金制的链条,任何企图拆解的念想都是虚妄。
The appearence of law just like human being＇s coming into being, which is accidental. However the law originates from the person＇s instinct reason, which is person＇s choice of opposing natural owing to oneself sense of justice, which is also necessary for human being＇s self-protection, and which has drawn support from ordered conflict form, but its significance lies in the harmony of human society. Law was born for the harmony of human society, that is, law exists for person. Harmony of law and society should belong to a significent proposition. The society is the source of law, and law is the stream of society . Person--society--law is a golden chain.
