摘要
近年来,随着执法相对人法律意识的增强,对卫生处罚案件的办理提出了更高的要求。作者通过行政处罚决定书的主体、违法事实、法律依据、处罚内容、权利救济等五个方面要素进行分析和探讨,对完善卫生处罚案件调查处理程序,提高行政处罚案件的质量提供一定的参考。
as the legislative consciousness of relative executives enhances, further requirements have been put forward toward the transaction of hygiene penalty cases. By analyzing and discussing the five main factors, say, the subject of admini- strative penalty determinate document, the fact of violating law, the basis of the law, the content of penalty, the relief of right, this paper offers a certain references to the perfection of the investigation and handing process of hygiene penalty cases and the promotion of the quality of administrative penalty cases.
