摘要
正当程序作为理念,是西方法律思想、法律传统的体现,蕴含着人类对自身命运的关怀和对正义理想的追求。正义观念往往同自然法概念联系在一起。正当程序作为制度,通过程序实现自然法的正义理念,建立起通过程序的正义和通过程序的法治理论。正当程序的价值体现在对人的权利的保护之上,既具有相对于实体的程序价值又具有自身的独立价值。
As a thought, due process of law embodies the western legal tradition, contains the caring of the human destiny itself and the pursuit of the justice ideal. The thoughts of justice often connect with the natural law. As a system, due process realizes the thoughts of natural justice through procedure, and establishes the theory of rule by law through procedure. The value of due process embodies the protection for the human rights, not only the procedural value relative to the entity but also its inde pendent value.
