摘要
作为一种执法理念的公诉观,应顺应国家意志的阶段性重心要求。以社会发展的眼光,挖掘公诉观的应然状态,极具理论和现实意义。公诉观的内在品质体现在一系列基本理念中,包括:宽和、理性、人性。宽和的司法心境是实现公诉理性和人文关怀的前提和基础。公诉的理性精神深刻影响和决定着公诉的过程和公诉的质量,是公诉的逻辑起点。人性、人道则是公诉观的内在禀赋。
As part of the notion of law enforcement, the conception of puhlic prosecution should conform to the staggered requirement of the state will. It is of theoretical and practical importance to extract how the conception of public prosecution ought to be in the perspective of social development. The elementary features should be remission, rationality and humanity; the remissive judicial frame of mind is the precondition of rationality and humanity, the rational spirit which is the logical origin of public prosecution may effect and determine the process and quality of public prosecution, and the humanity and humanism are inherent virtue.
