摘要
任何刑事错案的背后总有形形色色的证据问题存在。刑事错案本质上是一个不折不扣的实务问题而非纯理论问题,关注刑事错案必须从扎扎实实的实证研究开始。为了无辜者的权益和刑事被害人的利益,也为了社会的安宁与和谐,我国的司法体制建设应当从现实生活中的每一起典型错案开始,这是当前研究英美刑事错案现状的重要启示。
Varlous evidence problems always concealed behind the misjudged criminal cases, therefore misjudged criminal cases are one hundred percent not theoretical but practical issues and should be regarded from demonstrative research. In the process of the establishment of Chinese judicial system, each representative misjudged criminal case in actual life should be considered seriously in order to protect the interests of the innocent and the rights of the victim and safeguard social welfare and harmony ; that would be the most important inspiration from the study on present Anglo - American misjudged criminal cases.
