摘要
对于大量存在的比较隐蔽、性质难以确定的违法侦查行为,目前尚处于发现不了、无法核实、纠正不力的状态。主要表现在:对违法侦查行为监督的方式滞后、被动;对违法侦查行为无法及时启动调查;对违法侦查行为监督的效力不足。要防止乃至最终杜绝冤错案件的发生,必须从制度入手,建立一套以调查为核心内容的发现、核实、纠正违法侦查行为的工作机制。
Quite a few illegal investigation acts are concealed and indistinct that in a situation of undiscoverable, unverifiable and almost uncorrectable, of which the characteristics manifest as fonow： passive and afterwards supervision to the illegal investigation, tardive initiation of investigation to the illegal acts, and insufficient supervision effectiveness to the illegal investigation. A working mechanism should be established with the core method of investigation to discover, verify and correct the illegal investigation acts to prevent and finally end the misjudged cases.
